中国共产党在中国的民主政治中居于领导地位。当代中国实行中国共产党领导的多党合作和政治协商制度，党的领导是人民当家作主和依法治国的根本保证，人民当家作主是社会主义民主政治的本质和核心，依法治国是党领导人民治理国家的基本方略。中国共产党的领导地位是人民的选择、历史的选择，并且这一领导地位是由我国宪法以根本大法的形式加以确立的。
人民代表大会制度是人民当家作主最重要的实现途径和制度载体。人民代表大会制度是中国的根本政治制度。人民以投票选举的方式，选出自己的政治代表，组成全国人民代表大会和地方各级人民代表大会；人民代表大会选举产生国家的行政机关、审判机关与检察机关，分别行使国家的行政权、审判权和检察权；行政机关、审判机关、检察机关向人民代表大会负责，接受人民代表大会的监督；人民代表大会向人民负责，接受人民的监督。这充分反映了当代中国民主政治的精神实质，即国家的一切权力属于人民、来自于人民、受人民监督。
协商民主是人民当家作主的重要形式。协商民主是中国社会主义民主政治的特有形式和独特优势。一方面，从法理上看，新中国可以视为协商民主的产物。1949年中国人民政治协商会议第一届全体会议召开，宣告了中华人民共和国成立，这种“协商建国”是史无前例的伟大创举。另一方面，当代中国的人民政协制度作为中国共产党领导的多党合作和政治协商的基本制度，在政治协商、民主监督、参政议政方面发挥了重要作用，具有不可替代的民主功能。独具中国特色的“两会”成为中国民主政治的直观体现，也是对人民当家作主的全面展示。
澄清民主问题上的错误观念
从民主理论看，西方政治思想史上并无“民主政体”与“非民主政体”的划分。在西方，亚里士多德把政体分为君主政体、贵族政体、共和政体三种类型，这三种政体的变异状态分别是僭主政体、寡头政体和平民政体。亚里士多德并没有将国家划分为“民主国家”与“非民主国家”。事实上，西方古典的政治理论并不推崇民主政治，而更看重混合政体。
从民主实践看，没有哪个国家是纯粹意义上的民主国家。英国的政体是典型的混合政体，既有民主的因素，也有君主的因素，还有贵族的因素。美国同样不是一个纯粹意义上的民主国家。美国实行三权分立，司法权作为“三权”之一，掌握在法院特别是联邦最高法院手里。这实际上是守护资产阶级核心利益的制度防线。美国国会作为民主的象征，其代表民意制定的法律可以被联邦最高法院宣布为无效。通过解剖英国、美国这样有代表性的国家，我们可以发现，所谓“民主国家”与“非民主国家”这种二分法是不科学的。
从中国的现实来看，当代中国已经发展成为一个新型民主国家。中国积极借鉴人类政治文明有益成果，但没有照搬西方政治制度模式，不搞多党轮流执政，不搞“三权鼎立”和两院制。中国的民主政治是人类政治文明中的创新典范，对世界民主政治的发展作出了贡献。因此，给当代中国贴上“非民主国家”的标签，是对民主理论的误解，更是对中国民主实践的误解。至于“专制国家”的标签，要贴在当代中国的国家体制上，更是无聊之举。
